Four Tourists Killed in Motor Vehicle Accident in Delray Beach
A recent tragic accident in Delray Beach killed four tourists visiting Florida from South America. According to a report from the Sun-Sentinel regarding the crash, the deceased victims included a mother and her two young children from Mexico and her brother, who hailed from Argentina.
The accident occurred when a 21 year old driver traveling at an extremely high rate of speed on South Federal Highway in Delray Beach swerved across multiple lanes of traffic and crashed straight into the tourists’ minivan as it waited in a turn lane. The young driver had just played golf and was driving with his roommate to their apartment according to his attorney.
The attorney also claimed that his client’s vehicle suddenly lurched into high speed. According to police, the impact was so hard that Delray Beach firefighters had to use a mechanical winch to separate the vehicles. A third car was also involved in the accident, the occupants of which had minor injuries as a result of the collision.
The driver of the vehicle that caused the crash was unharmed as a result of the crash, but his passenger (and roommate) had to be taken to the hospital for his injuries. The young driver’s attorney has claimed he was not under the influence of alcohol or any other substances at the time of the accident.
The Police Investigation and Justice for the Victims
The young driver’s attorney also raised the issue that his client’s vehicle lurched suddenly into an uncontrollably high speed as a result of a possible mechanical failure, so Delray Beach police are investigating whether some sort of mechanical failure could indeed have caused the vehicle to accelerate suddenly.
According to a report from the Palm Beach Post, witnesses estimated that the 21 year old’s car was going 100 mph in a 45 mph section of Federal Highway when the accident occurred. The police investigation likely will take some time, but the driver was released and has yet to be charged criminally. Regardless of who is eventually found at fault, the estates of the victims as well as any of their survivors (such as the Mexican sister’s husband) will be entitled to pursue recovery of their damages against all tortfeasors who contributed to the four individuals’ deaths in a wrongful death lawsuit.
If police determine this to be some malfunction on the part of the driver’s car, then the vehicle’s manufacturer (General Motors) could be held liable for the deaths. If the 21 year old is found by police to be responsible for the crash, then he could face criminal charges and would also be subject to civil lawsuits by the estates and survivors of those who were killed or injured in the collision.
